Terms of use for members of the savvy circle.

Preliminary remarks

In addition to standard supersavvyme membership, supersavvyme and Procter & Gamble offer registered users and supersavvyme members the opportunity to take part in projects as members of the savvy circle and test and evaluate new products. Additional services offered on the website, such as discussions on savvy circle project blogs may also be used.

Upgrading supersavvyme membership to being a member of the savvy circle, does not oblige members to take part in savvy circle projects. Supersavvyme members are not charged any fee for upgrading their membership or for taking part in projects for members of the savvy circle.

These Terms of Use govern your conduct in connection with the supersavvyme savvy circle service.

Scope

These terms and conditions apply to all supersavvyme members who have upgraded their membership to a being a member of the savvy circle.

Registration

Users must be registered as supersavvyme members in order to upgrade to being a member of the savvy circle and take part in savvy circle projects, such as testing new products.

Please ensure all your details are correct when you upgrade to being a member of the savvy circle. After creating your new account, you'll receive an email to verify your email address.

Data protection/personal data

supersavvyme's privacy regulations apply to the use of personal data supplied when creating a savvy circle account, as well as other data protection matters. These can be found at http://www.pg.com/privacy/english/privacy_notice.html.

Term, termination

Upgrading to a savvy circle account, does not oblige users to take part in savvy circle projects.

Users may terminate their savvy circle account at any time by cancelling or deleting it.

Rules of use, participation in projects, savvy circle stars

When taking part in the savvy circle programme and communicating with other members, all members of the savvy circle are required to comply with the applicable laws and treat other members politely and with respect.

As part of savvy circle projects, products from Procter & Gamble will be provided to a select group of members (of the savvy circle) for testing purposes. When contacted, members (of the savvy circle) will be expected to test, evaluate and spread the word about the products to other people. If products from advertisers are recommended to others, members (of the savvy circle) must mention that they are taking part in a supersavvyme savvy circle marketing project. Members (of the savvy circle) should always only express their opinions on products. Further details are set out in the Terms of Participation for each project, which shall take precedence in case of doubt compared with these general terms and conditions.

Users have no legal right to participate in specific projects. Participants for a project will be selected on the basis of members' details and according to their interests and tendencies. The decision of supersavvyme is final. Members are generally required to be of legal age to take part in projects.

supersavvyme reserves the right to exclude members (of the savvy circle) from a project in the event that these Terms of Use or a project’s specific Terms of Participation are breached. Goods or articles received by members (of the savvy circle) as part of a project organised by supersavvyme or Procter & Gamble constitute product samples which may not be sold. The sale of these products, particularly on platforms such as eBay, is prohibited. It should be noted that the unauthorised sale of any samples may breach the brand owners' trademark rights given that the advertiser has not marketed the test products for sale.

savvy circle stars are awarded for engaging in the savvy circle programme. savvy circle stars have no cash value and may not be settled in cash. savvy circle stars may only be used accordingly for offers on the website. savvy circle stars are not transferable. The number of savvy circle stars awarded for taking part in a project shall be determined on an individual basis by supersavvyme. supersavvyme reserves the right to change, extend or shorten the savvy circle stars programme at any time.

Changes to these Terms of Use

supersavvyme reserves the right to make changes to these Terms of Use. Members will be notified of such changes either when logging into the supersavvyme platform or by email. In the event that members do not agree with the changes, they will be required to terminate their membership. Otherwise changes will take effect from a point in time specified by supersavvyme.

Copyright

The contents of the supersavvyme savvy circle website and other documents and material provided to members (of the savvy circle) by supersavvyme are protected by copyright and may only be used in accordance with supersavvyme’s guidelines and conditions. Any other reproduction, distribution, rendering or public disclosure is prohibited without the consent of the copyright holder.

In cases where supersavvyme offers software to download, this only includes the right to use such software as intended and on one computer.

You retain all of your ownership rights in your uploaded content and by entering the Promotion and uploading your content, there is no assignment of any intellectual property rights in your material to Procter & Gamble. However, by submitting your content, you hereby grant to Procter & Gamble a worldwide, non-exclusive, royalty-free, perpetual, transferable licence to use, reproduce, distribute and display the content [on eg. Facebook, and] in any media from time to time required for the purposes of the Promotion. You understand that your entry will be accessible by all viewers of the savvy circle pages onto which is it uploaded. This license granted by you terminates when you remove or delete any material from the savvy circle pages.

By submitting content to the supersavvyme savvy circle, you represent and warrant that:

• You are the sole author and owner of the intellectual property rights thereto;
• All content you submit is accurate;
• You are at least 18 years old;
• Use of the content you supply does not violate these Terms of Use.

You should not upload (i) any content belonging to anybody else, such as material which contains trade marks and/or copyright protected material, any material broadcast on TV or Radio, or any other material that does not belong to you; (ii) any sensitive information about someone's mental or physical health, political or religious beliefs; (iii) anything that is derogatory to any person or members of a particular race, nationality, sex, sexual orientation or religion or incite hatred of particular groups; (iv) anything that is abusive, bullying or name calling of other people; (v) anything that in any way exposes information of a private nature, is spam, is sexually explicit, depicts violence, sadism or cruelty; (vi) anything that condones illegal drug usage; (vii) anything that portrays any corporation negatively; (viii) anything which promotes your own products or services.

You agree to indemnify and hold supersavvyme and Procter & Gamble UK - Weybridge, Surrey, KT13 0XP - (and its officials, executives, directors, representatives, subsidiaries, joint ventures, employees and third-party service providers) harmless from all claims, demands and damages – including any legal and court fees – arising from a breach of your representations and warranties set forth above.

supersavvyme and the respective brand reserve the right to moderate, change, condense or delete any content on supersavvyme’s website that supersavvyme and the brand deem, at their discretion, to violate the content guidelines or any other provision of these Terms of Use, prior to its uploading on supersavvyme.

supersavvyme reserves the right to remove or refuse to publish any submission for any reason. You are responsible for the contents of your contributions within the scope of your relationship with supersavvyme.

Availability of website and supersavvyme savvy circle services

supersavvyme reserves the right to discontinue its website and its services at any time as well as to terminate the relationship at any time. The website and other services may also be temporarily unavailable due to technical problems. Members (of the savvy circle) have no right to demand that the savvy circle website and supersavvyme savvy circle services be available at all times.

Severability, choice of law

Should any individual provisions be or become invalid, the validity of the remaining clauses will not be affected as a result. English law shall apply to the relationship established between the member (of the savvy circle) and supersavvyme.
